Terms of sale

1. Purpose

These terms govern distance sales of pre-owned luxury handbags made through the JALOUZE website to consumers, by SMS CONSEIL, SASU with a share capital of 1,00 €, 5 rue Crevaux, 75016 Paris, France, 939 646 329 R.C.S. Paris, VAT FR77939646329 (the "Seller"). Placing an order implies acceptance of these terms.

2. Pre-owned products

All pieces are pre-owned and unique. Their condition (from "Never worn" to "Fair condition"), any defects and included accessories are described on each product page, illustrated by photographs of the actual piece. Minor signs of wear consistent with the stated condition do not constitute a lack of conformity.

3. Prices

Prices are shown in euros, all taxes included, excluding any delivery costs indicated before the order is confirmed. VAT regime: [À COMPLÉTER]. The price applicable is the one displayed at the time of ordering.

4. Order and payment

The customer selects a piece, fills in their details and confirms the order. The Seller then confirms availability and sends, within 24 hours, a secure payment link by email. The sale is final upon receipt of full payment. Until then, the piece is reserved for the customer. Failing payment within the stated time, the order may be cancelled.

Bespoke sourcing: once the customer approves a proposal, a deposit (by default 30 % of the price including VAT, as shown on the proposal) is paid to reserve and purchase the piece; the balance is paid before shipping. The amounts of the deposit and balance are stated on the proposal page and in the tracking page.

5. Delivery

Pieces are shipped insured and tracked, delivered against signature, to the address provided by the customer. Each bag is accompanied by its inspection photographs and authentication certificate. Any visible damage must be noted with the carrier upon delivery and reported to contact@jalouze.com within 48 hours.

6. Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, the customer has 14 days from receipt of the piece to withdraw, without giving reasons. The customer notifies their decision by email to contact@jalouze.com (the EU model withdrawal form may be used). The piece must be returned within 14 days of this notification, in its original condition, with all accessories, labels and certificates, by insured and tracked shipping at the customer's expense. The Seller refunds all sums paid, including standard delivery costs, within 14 days of receiving notification, and may defer the refund until the piece is received. A piece returned damaged or incomplete may result in a reduction of the refund.

7. Legal guarantees

The customer benefits from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). For second-hand goods, the period during which a lack of conformity is presumed to exist at delivery is 12 months.

8. Authenticity guarantee

Every piece is authenticated before sale (including Entrupy authentication where applicable). Should a piece be proven not authentic by a recognised expert, the Seller will take it back and refund the full price paid, including delivery costs.

9. Bespoke sourcing

Submitting a sourcing request is free and carries no commitment or payment. When a piece is found, it is presented with detailed photographs and a firm price. The customer is only bound once they accept the proposal and pay the requested deposit; the balance is paid after final authentication and before shipping. These terms then apply to the sale.

10. Consumer mediation

In the event of a dispute, the customer should first contact contact@jalouze.com. Failing an amicable solution, the customer may refer the matter free of charge to the consumer mediator: [À COMPLÉTER]. The European online dispute resolution platform is also available.

11. Governing law

These terms are governed by French law. Failing an amicable agreement, disputes fall within the jurisdiction of the competent French courts, without prejudice to the protective rules of the consumer's country of residence.
